SMS CONSENT

This SMS Consent Policy explains how Summit Systems, LLC dba Summit Systems (“Summit Systems,” “Company,” “we,” “our,” or “us”) obtains and records consent from end-users to receive transactional SMS messages sent through the Summit Systems platform.
This policy applies to all SMS messages transmitted through the Summit Systems Text-to-Pay system on behalf of participating restaurants.
CONSENT COLLECTION PROCESS
Summit Systems provides a software platform that allows restaurants to send secure payment links and order-related updates via SMS to customers who place phone orders.
During the ordering process, the restaurant asks the customer for permission to receive SMS messages related to their order.
If the customer agrees, the restaurant enters the customer’s mobile phone number into the Summit Systems Text-to-Pay Order Entry Portal and confirms that the customer has provided consent to receive SMS messages related to the order.
The system requires the restaurant to verify customer consent before a secure payment link can be sent.
By voluntarily providing a mobile phone number and agreeing to receive messages, the end-user consents to receive transactional SMS communications related to the specific order placed with the restaurant.
Consent to receive SMS messages is not a condition of purchase.
VERBAL CONSENT SCRIPT
Consent is obtained verbally by restaurant staff during the phone ordering process. The following script is used by restaurant staff when collecting customer consent:
Staff: “Before I finish your order, I’d like to send you a secure payment link by text message so you can pay before pickup. You’ll also receive a payment confirmation and order updates by text. Message and data rates may apply. You can opt out at any time by replying STOP to any message. Do I have your permission to send these messages to your phone number?”
Customer: “Yes.”
Staff: “Thank you. I’m sending the payment link to your number now.”
After the customer verbally agrees, the restaurant staff enters the customer’s phone number into the Summit Systems Order Entry Portal and checks the consent confirmation box before any SMS is sent. No message is transmitted until this confirmation step is completed

SMS DISCLOSURE
Customers are informed during the order entry process that:
• SMS messages will be sent in connection with their restaurant order
• Message frequency varies per order
• Message and data rates may apply depending on the customer’s mobile carrier plan
• Customers may reply STOP at any time to opt out of receiving messages
• Customers may reply HELP for assistance
These SMS messages are strictly transactional and are limited to communications necessary to complete or update the customer’s order.
TYPES OF SMS MESSAGES SENT
SMS messages sent through the Summit Systems platform may include:
• Secure payment links
• Payment confirmations
• Order preparation notifications
• Pickup readiness alerts
• Payment reminders if payment has not yet been completed
SMS messages are not used for advertising or promotional purposes unless separately authorized and registered in compliance with applicable telecommunications regulations.
CONSENT VERIFICATION
The Summit Systems order entry portal includes a consent confirmation mechanism that requires the restaurant to confirm that the customer has agreed to receive SMS messages before a secure payment link can be transmitted.
Restaurants must verify customer consent prior to initiating any SMS message through the platform.
Clients using the Summit Systems platform are responsible for ensuring that proper consent is obtained from customers in accordance with applicable telecommunications laws and regulations.

Below is an example of the Summit Systems Text-to-Pay Order Entry Portal used by restaurants when collecting customer phone numbers and confirming SMS consent prior to sending SMS messages.
This interface demonstrates how consent is obtained before SMS messages are sent to customers.
DATA USE AND PRIVACY
Phone numbers collected for SMS messaging are used solely for transactional communications related to the customer’s order.
Summit Systems does not sell, rent, or share phone numbers collected for SMS messaging with third parties or affiliates for marketing purposes.
SMS consent and phone numbers collected for SMS purposes will not be shared with third parties or affiliates for marketing purposes.
