OVERVIEW OF SERVICES

Summit Systems provides transactional SMS payment automation software designed for restaurants and food service businesses. The platform enables restaurants to send secure payment links and order-related updates to customers via SMS after a phone order is placed.

Summit Systems operates solely as a software platform provider. Summit Systems does not operate as a payment processor, financial institution, or merchant of record. All customer payments are processed directly through Stripe using the restaurant’s individual Stripe account.

SMS PROGRAM DESCRIPTION

Summit Systems provides a transactional SMS messaging program that allows participating restaurants to send customers secure payment links and order status notifications after a phone order is placed.

Customers opt in to receive these SMS messages by voluntarily providing their mobile phone number to the restaurant during a phone order after being informed that their number will be used to send a secure payment link and order-related updates.

The SMS messages are sent by Summit Systems on behalf of the restaurant solely for the purpose of completing the transaction associated with that order.

Message frequency varies and is limited to communications directly related to the specific order placed by the customer.

Messages may include:

• Secure payment links  

• Payment confirmations  

• Order preparation updates  

• Pickup notifications

Message and data rates may apply depending on the recipient's mobile carrier plan.

Recipients may reply STOP at any time to opt out of SMS messages or reply HELP for assistance.

SMS consent is not a condition of purchase.

Summit Systems does not collect, process, or store full customer credit card numbers. Payment card information is handled exclusively by Stripe.

SMS messages are transmitted by Summit Systems’ messaging infrastructure on behalf of participating restaurants solely for transactional communications.

PAYMENT PROCESSING

All payment transactions initiated through the Summit Systems platform are processed directly through Stripe.

Stripe is responsible for securing and processing payment card information in accordance with its own privacy policy and industry security standards. Summit Systems does not access, control, or store customer credit card data.

DATA RETENTION

We retain information only as long as necessary to:

• Provide and maintain the Services  

• Comply with legal obligations  

• Resolve disputes  

• Enforce contractual agreements  

• Prevent fraud or misuse

Certain records may be retained after account termination for compliance, accounting, or legal defense purposes.

DATA SECURITY

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction.

However, no internet transmission or electronic storage method is completely secure, and we cannot guarantee absolute security.

Access to system data is restricted to authorized personnel and approved service providers who require such access to operate the platform.

CLIENT RESPONSIBILITIES

Restaurants using the Summit Systems platform are responsible for obtaining appropriate customer consent prior to initiating SMS communication.

Clients must ensure their use of the platform complies with all applicable federal, state, and local laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA messaging guidelines, and mobile carrier requirements.

Summit Systems is not responsible for improper consent collection, unlawful marketing practices, or regulatory violations arising from a client’s independent business practices.

CHILDREN'S PRIVACY

The Services are intended for business use and are not directed toward individuals under the age of eighteen. Summit Systems does not knowingly collect personal information from minors.

BUSINESS TRANSFERS

In the event of a merger, acquisition, restructuring, financing, asset sale, or similar transaction, information may be transferred as part of that transaction in accordance with applicable law.

Business account holders may request access to or correction of their account information by contacting support@getsummitsystems.com.

CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically. Any updates will be posted with a revised “Last Updated” date. Continued use of the Services following any modification constitutes acceptance of the updated policy.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Summit Systems shall not be liable for data breaches, unauthorized access, third-party service provider failures, cyberattacks, or circumstances beyond our reasonable control.

GOVERNING LAW

This Privacy Policy shall be governed by and interpreted in accordance with the laws of the State of Nevada, without regard to conflict of law principles.
